Next, it must be established that the defendant’s breach was the direct cause of his or her injuries. Finally, the victim must present evidence of the damages that he or she suffered as a result of the breach. Common examples include medical costs, physical therapy, lost wages, loss of future earning capacity, and pain and suffering.
