Bring a Negligence Claim to Seek Compensation

Even when we go about our daily activities as safely and carefully as possible, suffering harm as the result of an avoidable accident can happen. Fortunately, the law requires a careless individual or entity to compensate a victim for the injuries and costs that he or she sustains. Common examples of potentially serious accidents include car, truck, and motorcycle accidents, as well as medical malpractice, pharmacy misfills, and medication errors.

The first step in pursuing compensation for your injuries is usually to bring a claim for negligence. This type of action requires a victim to prove four elements: duty, breach, causation, and damages. Duty involves whether the defendant acted according to the applicable standard of care, which generally requires each of us to act with the same ordinary care and skill that a reasonably prudent person would use in a similar situation. The victim must next show that the defendant failed to adhere to this duty of care, or breached it, by engaging in some careless conduct.

The third element of negligence is called causation, and it requires the victim to establish that the defendant’s breach of the duty of care was the direct cause of his or her injuries and that the accident was foreseeable. The final element of negligence, damages, requires the injured individual to provide evidence of the physical and financial harm that he or she has suffered as a result of the defendant’s negligence. This usually includes medical bills, previous paychecks, and other expenses incurred as a result of and in connection with the injuries.

There are a number of categories of damages that may be available to an injured person, including medical expenses, long-term treatment, lost wages, loss of future earning capacity, property damage, and pain and suffering. Unfortunately, some tragic accidents result in the victim’s death. In this situation, surviving family members can bring a claim for wrongful death, which seeks to compensate the victim’s close relatives for the loss of their loved one’s companionship, support, and love.
