The second element of negligence requires the plaintiff to show that the defendant’s conduct failed to meet the duty of care, resulting in a breach.

Third, the plaintiff must show that the defendant’s breach was the direct cause of his or her injuries. Causation requires the victim to prove that he or she would not have been hurt if the defendant had met the appropriate standard of care. In the context of a medical malpractice case, for example, common causation issues involve the failure to diagnose an injury, improper diagnosis, and medication errors.

The last element of negligence requires a victim to provide evidence of his or her damages. Examples of categories of compensation available to many injured individuals include medical expenses, physical therapy, lost wages, loss of future earning capacity, and pain and suffering.
