In other words, the plaintiff must show that he or she would not have been hurt but for the defendant’s carelessness.

In the final stage, the injured person must provide evidence showing the physical and financial costs and losses that he or she sustained. A plaintiff often may pursue several categories of damages, including medical expenses, physical therapy, lost wages, loss of future earning capacity, property damage, and pain and suffering. In some instances, the close surviving relatives of the victim may bring a claim called loss of consortium, which seeks to compensate the relatives for the loss of their loved one’s companionship, support, and love. Unfortunately, some severe accidents result in the victim’s death. In this situation, the surviving relatives may bring a wrongful death claim seeking compensation for the loss of their loved one.
